Lahore High Court Annuls Imran Khan’s Physical Remand in May 9 Protest Cases

The Lahore High Court LHC on Thursday set aside the physical remand of Pakistan Tehreek-e-Insaf PTI founder Imran Khan in a dozen cases for the violence protests that occurred in the country on the 9th of May the last year.

A two-member bench of the LHC headed by Justice Tariq Saleem Sheikh reserved the judgment while hearing the petition to challenge the former prime minister’s physical remand.

The high court also quashed the notification for appearance through video link with Imran Khan’s court.

According to Justice Saleem speaking when the matter was being heard in the court the suspect in question cannot be forced to take a photogrammetry test. Justice Pannu openly asked the Prosecutor General Punjab Mr Farhad Ali Shah some questions stating the modern devices. Shah agreed that the photogrammetry test could be done inside the jail and stated that it would be ‘inequitable’ if the prosecution is not availed ‘a full opportunity.

“The prosecution is put at the dock if it does not succeed in the end,” Shah said.

The prosecutor also informed the court that without retrieving the mobile phone used in the act of posting the tweet and sending messages via the WhatsApp will be an unachievable undertaking.

Justice Pannu then queried as to how the mobile phone could be retrieved in case the suspect was in jail.

It is important to note that Imran Khan had petitioned the anti-terrorism court’s (ATC) decision; he argued that the record was not evaluated appropriately when his physical remand was awarded to the Police.

Ahuja last week an ATC in Lahore gave the physical remand of the PTI founder for 10-day in 12 cases regarding the riots on May 9. Five of them were lifted from Sarwar Road police station while three were from Gulberg police station, one each from Race Course, Shadman, Mughalpura and Model Town police stations.
